Symmetry Software Privacy Policy

Symmetry Software LLC (“Symmetry”, “us”, or “we”) believes that privacy is important to the success of the Internet, and as such, is committed to protecting the privacy of individuals whose personal data we collect. Symmetry’s Privacy Policy (this “Policy”) explains how your Information (as defined below) is collected, used, and used by us, how we collect Information through the use of cookies and related technologies, and the choices Symmetry offers regarding its collection and use of personal data.

This Policy applies to Information we obtain from or about you in an online and offline context such as when you (a) visit our website and other locations where this Policy appears (collectively, our “Sites”); (b) use Symmetry’s cloud and other client applications (our “Services”); (c) interact with our social media pages, customer support, online chats, or community forums; or (d) participate in or attend our events and demonstrations. Certain sections may not be applicable to you depending on how you provide your Information to us or interact with us.

Symmetry reserves the right to change this Policy by reasonable notice, including without limitation, by posting revised terms on our Sites (which shall constitute reasonable notice), and such amended terms will go into effect and shall be binding upon you as soon as they are posted to the Sites. Thus, you should consult the most recent version of this Policy each time you view a Site. Your continued use of any Sites after the effective date of such changes constitutes your acceptance of and agreement to such changes.

Symmetry’s Sites are not intended for children and not marketed or directed to children under the age of 13. We do not knowingly receive, collect, maintain or use personal information from children under the age of 13.

Personal data collected

The information we receive, collect, maintain or use includes information that is both Personal and Non-Personal. “Personal” information is a broad concept and refers to any data, either alone or in combination with other information, by which a natural person can be identified or located, or that can be used to identify or locate a natural person. This includes references to obvious identifiers such as a name but also non-obvious identifiers such as an identification number or an online identifier such as an IP address or cookie identifier. “Non-Personal” information refers to information that is anonymous whereby you are not or no longer identifiable from that information. We receive, collect, maintain and use the following general types of Personal and Non-Personal information (together, “Information”).

Information Obtained Directly from You. Symmetry collects Information from you when you provide it through our Sites or other interactions with us. Examples of such information include your name, contact information, gender, job title and function, username and password, billing and payment information (including exemption certificate numbers), as well as other Information you may volunteer to us (e.g., event feedback or business card).

Information Automatically Collected about You. Symmetry automatically obtains Information about you if you access our Sites. This includes (a) Information about the devices you use including your device’s IP address, your browser type and version, geographic location, and operating system and platform; (b) Information about your visit to our Sites including the URL clickstream to, through, and from our Sites (including date and time); products and services you have viewed or searched for, your account activity (when logged in); the content (and any ads) you view or interact with, page response times, download errors, length of visits to certain pages and page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page. If you or your company uses our Services and we provision you an account, we may collect your name, email address, associated IP address, your devices operating system type, device identifiers, browser type, domain name, access times, the duration of visit, and other information. Some of this Information is collected using cookies and related technologies (please see the section titled Cookies and Related Technologies below).

Information Obtained from Other Sources. From time to time, (where permitted by applicable law), we collect Information such as contact information, your preferences, and other demographic data from trusted third-party sources that are either publicly or commercially available (e.g., business partners, event providers, data brokers, social media networks, advertising networks, analytics providers, and search information providers) which will be used for the purposes outlined in this Policy.

We also receive Information you provide to our authorized Resellers and Partners of our products and services which will be used for the purposes outlined in this Policy.

When you pay for our products and services, we get information from our payment processing service provider who will carry out credit and antifraud checks on you and the payment method you provide in order to verify your identity, to validate your credit or debit card, to obtain an initial credit or debit card authorization, and/or to authorize the purchase.

In order to ensure data accuracy and to offer you a better experience, we link or combine the Information that we collect from the different sources and channels outlined above (e.g., to provide targeted communications and advertising and for the other purposes outlined below).

You do not have to provide Personal Information to access Symmetry’s services, but certain functionalities (such as to get access to Customer Support) will not otherwise be available to you. You may however, choose whether or not to receive marketing communications from us and we will only send you such communications where we have the appropriate consent to do so. For more information on your preferences regarding how we use your Information for marketing purposes, please see the section titled Your Rights and Choices below.

You should not provide Personal Information about anyone unless you have their permission to do so and they understand how we will use their Personal Information as set out in this Policy.

Use of personal information

Whether you provide any Personal Information is entirely up to you. If you have voluntarily provided information, you consented to the collection and use of your Personal Information as described in this Policy. We process your Personal Information through electronic and manual means for the following purposes.

  • To fulfill a contract or to take steps at your request linked to a contract. These may include:
    • to administer and authorize your access to our Services, your accounts and other features and functionality of our products;
    • to process orders, provide for delivery of our Services, and send you service-related communications; and
    • for customer support purposes including responding to your queries and investigating any complaints about the Services.
  • As required to conduct business and pursue our legitimate interests. This may include:
    • to improve and personalize your experience with us and our Services and to provide you with tailored content, advertisements and communications;
    • to operate, support, and maintain our Services, conduct identity verification, authentication, and other fraud prevention or detection activities;
    • to send you information you have requested;
    • to ask your opinion or to take part in market research or a survey;
    • to monitor and improve the performance of our Services, analyze trends, usage and activities in connection with our Services, and optimize our marketing efforts and measure the effectiveness of our advertising campaigns;
    • for our own internal functions, such as keeping our Services secure, for management, corporate reporting and record keeping purposes, for internal research and analytics, for developing our products and services, and improving business efficacies;
    • to enforce compliance with our Terms of Use and other policies or otherwise in connection with legal claims, compliance, regulatory and investigatory purposes as necessary (including disclosure of such information in connection with legal process or litigation);
    • to avoid injury to a third-party, or to otherwise enforce or protect Symmetry’s rights under applicable law, including without limitation, Symmetry’s intellectual property rights; and
    • to create aggregate and statistical data (which cannot be used to identify you). For example, aggregate data may include data that describes the general demographics, usage or other characteristics of a Service’s users.
  • Where you give us consent. This includes:
    • where you ask us to send marketing information via a medium where we need your consent;
    • where you give us consent to place cookies or similar technologies; and
    • on other occasions where we ask for your consent, for the purpose we explain at the time.
  • As required by law, including:
    • in response to requests by government or law enforcement authorities conducting an investigation.

Use of non-personal information

Symmetry may provide aggregate statistics about visitors to our Sites, such as volume, traffic patterns, visitor demographics, and related Site information to reputable third-party vendors, but these statistics will not include Personal Information.

For certain Services, we may ask for and receive street addresses in various states in order to provide accurate paycheck calculations. These addresses are only used to accurately calculate paycheck information in this locale. We do not store street addresses, rather only the city and state information are stored.

Symmetry utilizes Google Analytics as a third-party service provider on our Sites. Google Analytics collects demographic and interest data from trusted external sources. Thresholds are applied to prevent anyone viewing a report from inferring the demographics or interest of individual users.

No sharing of personal information

Symmetry does not share or sell your Information to anyone. We do not give your Information to anyone outside of Symmetry for their promotional or marketing use. We do not collect Personal Information unless we first ask you for it. If you opt to receive additional information from Symmetry, you may get periodic emails from Symmetry or our trusted partners. These emails will contain information from Symmetry or other companies that offer legitimate products and services typically in the finance, taxation, accounting or payroll related areas. Again, Symmetry does not share or sell your Information to these companies. We directly manage any email campaign on behalf of these trusted partners.

Sensitive information

You are not required to provide Symmetry with any Information regarding your medical or health condition, race or ethnic origin, political opinions, religious or philosophical beliefs, or other categories of Information defined as sensitive or special categories of data under applicable data protection laws (“Sensitive Information”) in order to use our Services. Symmetry does not knowingly solicit or collect, and you should not provide to Symmetry, any such Sensitive Information, whether through our Services or through any other means.

Cookies and related technologies

Our Sites, like many other commercial websites, may utilize standard technologies like “cookies”, “web beacons”, and other automated tracking technology to collect information about how our Sites are used. Cookies are designed to help a website operator determine what particular user had visited the site previously and thus save and remember any preferences that may have been set while the user was browsing the site. Cookies are small strings of text that websites can send to your browser. Cookies cannot retrieve any other data from your hard drive or obtain your email address. If you are simply browsing our Sites, a cookie may be used to identify your browser as one that has visited the site before. Web beacons (also knowns as “single-pixel” or “clear GIFs”) include electronic images embedded in a site, application, or email used to pass information from your computer to us.

We may use cookies, web beacons, and other tracking technologies that expire once you close your web browser or that persist and stay on your computer until you delete them. We may also make use of memory-based cookies in support of authenticating the user of certain Site applications. Similarly, we may use cookies so that we can provide information based on preferences you have indicated while using the Site. Although you have the ability to modify your browser to either accept all cookies, notify you when a cookie is sent, or reject all cookies, it may not be possible to utilize certain Sites or Services which require registration if you reject cookies.

Certain web browsers and other devices you may use to visit our Sites or access our Services may permit you to indicate your preference that you do not wish to be tracked online. We do not modify your experience on these Sites or Services or the Information we collect from you based on whether such a preference is indicated.

Your rights and choices

Whenever we rely on your consent, you will always be able to withdraw that consent, unless we have another legal ground for processing your Personal Information. While Symmetry takes reasonable steps to ensure Personal Information we collect is reliable for its intended use, accurate, complete, and current, we rely on you to update and correct your Personal Information.

Security

Symmetry exercises great care to protect your Personal Information. This includes, among other things, using industry standard techniques such as firewalls, encryption, intrusion detection, and site monitoring. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, we cannot ensure or warrant the security of any information you transmit to us or receive from us. This is especially true for information you transmit to us via email. We have no means of protecting that information until it reaches us. Once we receive your transmission, we make our best effort to ensure its security on our servers. Internally, we will restrict access to your Personal Information to employees who need access to the information in order to do their jobs. These employees are limited in number, are committed to our privacy policies, and are kept up-to-date on security and privacy matters through regular training and education. All servers where we store Personal Information are kept in a secure environment. We will review our security arrangements from time to time as we deem appropriate.

Where Symmetry stores personal information

Symmetry is headquartered in Scottsdale, Arizona and operates its business within the United States. At all times, your Personal Information is stored and hosted within the United States and no Symmetry employee or agent (including subcontractor) has the ability to access or use your Personal Information from outside the United States.

How can you help protect your information?

If you are using a Symmetry website for which you registered and have login credentials such as a username and password, we recommend that you do not divulge your login credentials to anyone. We will never ask you for your login credentials in an unsolicited phone call or in an unsolicited email. In addition, we recommend you sign out of a registered site and close your browser window when you have finished your work. This is to ensure that others cannot access your Personal Information and correspondence if others have access to your computer. Symmetry Sites may contain links to other sites including those of our business partners. While we seek to link only to sites that share our high standards and respect for privacy, we are not responsible for the privacy practices employed by other sites.
